Access to the Mobile Application (App) and use of the Services offered on the Mobile Application is subject to this Privacy Policy. This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. These Services do not address anyone under the age of 18. Nebulous LLC does not knowingly collect personally identifiable information from children under 18. In the case Nebulous LLC discovers that a child under 18 have provided Nebulous LLC with personal information, Nebulous LLC immediately deletes this user from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that Nebulous LLC will be able to do necessary actions.

Limitation of Liability

SEE TERMS AND CONDITIONS FOR ADDITIONAL REQUIREMENTS. THERE IS A LIMIT OF LIABILITY FOR ANY CONDITION. IN NO EVENT WILL NEBULOUS LLC OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

1) ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; OR

2) ANY CLAIM, WHETHER IN CONTRACT OR IN TORT, THAT AROSE MORE THAN ONE YEAR PRIOR TO INSTITUTION OF SUIT THEREON.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU TO US DURING THE 6 MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING UP TO BUT NOT TO EXCEED ONE HUNDRED US DOLLARS $100.00.
